Placing Order with Direct Tuning

When you place an order with Direct Tuning or DirectTuning.com, you are entering into a binding contract with the Direct Tuning LLC.  The terms and conditions of this contract includes Direct Tuning's Return Policy, Condition of Use Policy, and all other Conditions listed on this web page. 

Product Ownership

Products will remain the ownership of Direct Tuning until they have been paid for in full.

Sales Tax

All sales transactions conducted in the State of California are accessed State, County, and City Sales Tax.

Payment

All Sales Transactions paid by Credit Card will only be shipped to a verified address that matches the record on file with the issuing bank.  If you wish to ship to an address other than your billing address, please contact your issuing bank and have your shipping destination added as an authorized alternate ship-to address in the record/memo field. We will contact your bank using the bank number you have provided to verify this information after you've placed an order. Please allow an extra day to verify any alternate ship-to address. Both your billing and shipping addresses must be verified before an order will ship. If you encounter any trouble when attempting to add an alternate shipping address, let the card issuer know that you are placing an online order and that the retailer must verify your personal information before shipment to eliminate the possibility of fraud. Then, simply give us a call at 1-866-420-2865 to let us know and we will re-attempt address verification to complete the processing of your order.  Orders with the same billing and shipping address are more likely to ship same-day.

Direct Tuning only accepts Domestically Issued Credit Cards.  Internationally Issued Credit Cards are not accepted (Credit Cards issued by foreign banks).  

All Sales Transactions paid by Pay Pal will only be shipped to CONFIRMED address on file with Pay Pal. 

All Sales Transactions paid by Personal or Company Check will be processed through Check Guarantee Service. Acceptance of the Check Payment is dependant on the approval of the Check Guarantee Service.  Temporary Checks will not be accepted.  

Product Information

All information presented on DirectTuning.com (including product specification, prices, country of origin, manufacturer claims, materials, design, features, color, documentation, and package contents are subject to change without notice. Product images used on our site are for reference only.  Products may be shown with optional items that are sold separately.  Images may not represent the actual product for your specific vehicle.  

Shipping

Depending on the product(s) ordered and the destination of the order, certain shipping services may not be available. All orders are packed carefully and correctly before it leaves our facility. All orders should be received and checked in the presence of the shipping carrier.  

In the event that an order arrives in a damaged condition, you must notify the shipping carrier and Direct Tuning immediately. You must keep all shipping cartons and packing material for carrier inspection. Direct Tuning will initiate the the claim with the carrier.

Shipment Shortage

In the event that an order arrives incomplete (shortage of item(s) or shortage of hardware or accessories for the purchased item), you must contact Direct Tuning within 48 hours of the receipt of shipment.  

Refused Shipments

In the event that you refuse a shipment, please contact Direct Tuning immediately.  It is the customer's responsibility to make all arrangements with Direct Tuning for refused shipments. All refused shipments are subject to Direct Tuning's Return Policy.  The Customer will be responsible for all shipping charges related to the refused shipment.  

Specialty Products

Personalized, Customized, or Specially Fitted Items are considered Special Order.  Special Orders must be paid in full at the time of order. Once a Special Order is placed, Direct Tuning will process the order in the most timely and efficient manner possible. In the event that there may be a delay, Direct Tuning will notify you of delay and keep you informed on all available information regarding your Special Order.  Due to the nature of Personalized and Customized Items, Direct Tuning cannot accept cancellations, refunds, or exchanges. 

Legal Venue

By visiting Direct Tuning's Web Site, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Direct Tuning LLC.

Disputes

Any dispute relating in any way to your visit to DirectTuning.com or to products you purchase through Direct Tuning shall be submitted to confidential arbitration in Chino Hills, California, except that, to the extent you have in any manner violated or threatened to violate Direct Tuning's intellectual property rights, Direct Tuning may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Disclaimer of Warranties and Limitation of Liability

This site is provided by Direct Tuning on an 'AS-IS' and 'AS-AVAILABLE' Basis.  Direct Tuning makes no representation or warranties of any kind, express or implied, as to the operation of this site of the information, content, materials, or products included on this site.  You expressly agree that your use of this site is AT YOUR SOLE RISK.  

To the full extent permissible by applicable law, Direct Tuning LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.  Direct Tuning LLC does not warrant that this site, its servers, or Email sent from DirectTuning.com are free of viruses or other harmful components.  Direct Tuning LLC will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, or consequential damages.  

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages.  If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
